DOCKETING STATEMENT INSTRUCTIONS

PLEASE FOLLOW THE INSTRUCTIONS REGARDING CONTENT, ESPECIALLY THE ATTACHMENTS, VERY CAREFULLY.

I.

APPEALS FROM DISTRICT COURT

The appellant must complete the attached Docketing Statement and file it with the clerk of the court of appeals within 10 days after filing the notice of appeal. An original and four copies must be filed. See 10th Cir. R. 3.4. The Docketing Statement must be accompanied by proof of service on all other parties to the appeal. Copies of the following documents must be attached to all copies of the Docketing Statement: A. The district court docket sheet which includes entry of the notice of appeal. (In multiple civil appeals arising out of the same or consolidated district court cases, complete copies of the district court docket sheet is only required to be attached to the Docketing Statement filed by the first appellant. Subsequent appellants shall attach to their docketing statements a copy of that page of the district court docket sheet showing the filing of the notice of appeal and any post-judgment motions.); The final judgment or order appealed All pertinent findings and conclusions, opinions, or orders which form the basis for the appeal; Any motion filed under Fed. R. Civ. P. 50(b), 52(b), 59, 60, including any

motion for reconsideration, and in a criminal appeal, a motion for judgment of acquittal, for arrest of judgment or for a new trial, with the certificate of service and the dispositive order(s); E. Any motion for extension of time to file the notice of appeal and the dispositive order; and The notice of appeal.

Please complete all sections of the Docketing Statement form except Sections I-B and I-C. Section V should only be completed in criminal appeals.

II.

PETITIONS FOR REVIEW OR APPLICATIONS FOR ENFORCEMENT OF AGENCY ORDERS

The Docketing Statement must be filed in the court of appeals within 14 days after filing a petition for review or application for enforcement. An original and four copies must be filed. The Docketing Statement must be accompanied by proof of service on all other parties. Copies of the following documents must be attached to all copies of the Docketing Statement: A. B. C. The agency docket sheet with the entry of the order to be reviewed; The order to be reviewed; and The petition for review or application for enforcement.

Please complete all sections of the Docketing Statement except Sections I-A, I-C, and V.

The Docketing Statement must be filed in the court of appeals within 14 days after the appeal is docketed. An original and four copies must be filed. The Docketing Statement must be accompanied by proof of service on all other parties. Copies of the following documents must be attached to all copies of the Docketing Statement: A. B. C. D. E. The Tax Court docket sheet with the entry of the notice of appeal; The decision appealed; The judgment appealed; and The notice of appeal. If the notice of appeal was filed by mail, proof of the postmark.
