This is the first step before any motions can be filed to modify or enforce the decrees, judgments, and orders of the other state. The party should file the entire foreign case with the appropriate Court. This process does not apply when children are involved. A child-custody determination may be registered in this state with or without a simultaneous request for enforcement. Parties will need to file with the Court a letter or other document requesting registration and 2 copies, including 1 certified copy of the out of state court order/determination to be registered. Parties will need to file with the Court a Verified Petition for an expedited enforcement and certified copies of all orders to be enforced and of any order confirming registration Upon the filing of a Petition, the Court shall issue an order directing the Respondent to appear in person at a hearing. This hearing must be held on the next judicial day after service of the Order. Upon the filing of a Petition seeking enforcement of a child-custody determination, the Petitioner may file a Verified Application for the issuance of a warrant to take physical custody of the child if the child is immediately likely to suffer serious physical harm or be removed from this state. Parties will need to file with the Court a verified Petition seeking enforcement and a verified application for the issuance of a warrant. Upon the filing of a Notice to Register an order from an out of state Court, Motions to modify and enforce can be filed.
