GENERAL INSTRUCTIONS
Who is subject to the surcharge Therecyclingsurcharge appliestoindividuals,estates,andtrustswhomustfilea Wisconsinincometaxreturnandhave: · Trade or business activities (including activities as a statutoryemployee)inWisconsinandhave$4,000,000 or more of gross receipts from trade or business activitiesforfederalincometaxpurposes. Exceptions The surcharge does not apply to an individualwhoisadulyordained,commissioned,orlicensed minister,memberofareligiousorder,orChristianScience practitioner.Thisexceptionislimitedtoincomerelatedto theperformanceofministerialservices,dutiesrequiredby theorder,orserviceasaChristianSciencepractitioner. Definitions Farming Farmingisthecultivationoflandortheraising orharvestingofanyagriculturalorhorticulturalcommodity includingtheraising,shearing,feeding,caringfor,training,andmanagementofanimals.Trees,otherthantrees bearing fruit or nuts, aren't treated as an agricultural or horticulturalcommodity.RaisingorharvestingChristmas treesisnotconsideredfarming. Gross receipts Gross receipts from trade or business activitiesinclude: · Totalreceiptsorsalesfromallfarmandnonfarmtrade orbusinessactivities(asdefinedlater)reportablefor federalincometaxpurposes,beforedeductingreturns andallowancesoranyotherbusinessexpenses.

· Totalwagesreceivedasastatutoryemployee,before deductinganybusinessexpenses. Gross receipts from nonfarm trade or business activities includetheamountfromline1offederalScheduleCorC-EZ plusthegrosssalespriceofbusinessassetsproducing ordinaryincomeorlossfromfederalForm4797. Gross receipts from farming include the total receipts orsalesfromlines1,4,5a,6a,7a,8aand9offederal ScheduleFplusthesalespriceoffarmassetsproducing ordinaryincomeorlossfromfederalForm4797. Net business income Net business income is the net profit(loss)fromtradesorbusinesses(asdefinedlater) except farming. It includes net income received as a statutory employee, reportable on federal Schedule C, line31,orScheduleC-EZ,line3.Thenetprofitisallbusiness income less all deductible business expenses for federalincometaxpurposes,eventhoughsomebusiness activitiesmaybeconductedoutsideWisconsin.Itincludes ordinaryincome(loss)reportedonForm4797,line18b. For purposes of computing the surcharge, net business income is reduced by the deduction for 50% of federal self-employmenttaxespaidonthebusinessincomeand forthefederalself-employedhealthinsurancedeductionif theinsuranceplanwasestablishedunderthebusiness.

Exceptions · Nonresidents of Wisconsin ­ net business income is theWisconsinportionofthenetprofitfromatradeor business(asdefinedlater). · Part-year residents of Wisconsin ­ net business incomeincludesthenetprofitfromall trade or business activities while a resident of Wisconsin, plus the net profitfromWisconsintradeorbusinessactivitieswhile anonresidentofWisconsin. Statutory employeeAnindividualwhoreceivesawage statement,FormW-2,thathasthe"Statutoryemployee" boxcheckedisastatutoryemployee.Statutoryemployees reporttheirincomeandexpensesrelatedtothatincome on federal Schedule C or Schedule C-EZ. Statutory employeesinclude: · Agent-drivers or commission-drivers who distribute meatproducts,vegetableproducts,bakeryproducts, or beverages (other than milk), or pick up or deliver laundryordrycleaning,

· Full-timelifeinsurancesalespeople, · Certainhomeworkers,and · Certaintravelingorcitysalespeople. Trade or business A trade or business is an activity regularlycarriedonforalivelihoodorwiththeintentionof makingaprofit.Tradeorbusinessincomeincludes: · IncomereportableonfederalScheduleC,C-EZ,orF. · Otherfederalself-employmentincome,suchasdirectors feesandwagesreceivedbyaU.S.citizenemployedby aforeigngovernmentintheUnitedStates.(Note The surchargedoesnotapplytoguaranteedpaymentsa partnerreceivesfromapartnership.)

Line 2Multiplytheamountofyournetbusinessincome by0.2%(0.002)andfillintheresultonline2.Exception If the result is less than $25 or if you have a net loss from trade or businessactivities,fill in $25.
