The prosecuting attorney has 10 days (+ 3 days if mailed) to reply. The court will not make a decision on your request until either the prosecuting attorney replies or at least 10 days pass after you serve the prosecuting attorney, whichever occurs first. You will be notified by mail of the decision. If your current trial date is less than three weeks from today, you should hand deliver your request to the prosecuting attorney's office and ask them to file a reply as soon as possible. If you have not heard from the court by the day before the trial date, you may call the Traffic Division at 264-0713 to find out if your request has been granted. If your request is denied or not ruled on before the trial date, you MUST appear for your trial.
