I JURISDICTION 1. The Plaintiff(s) on behalf of themselves and their minor children bring this

action to recover damages for a breach of fiduciary duties and for mismanagement of said trust, pursuant to 28 U.S.C. §§ 1491, 1505 et. seq. as is herein substantively alleged in the foregoing causes of action. II PARTIES 2. The Plaintiff(s) on behalf of themselves and their minor children are

descendant(s) of the Mdewakanton, who did not participate in the up-rising of 1862 and had ancestry that was considered to be loyal to the United States and/or lived or were removing to the State of Minnesota and are thus, beneficiaries to certain lands and assets now held by the United States on behalf of the Minnesota Mdewakanton Sioux Communities of Shakopee, Prairie Island and Lower Sioux and are further, descendant(s) of the December 2, 1863 Census; 1886 McLeod Census; 1889 Henton Census; 1889 Scout Census by Samual Brown; 1892 Scout Census by S.H. Elrod; 1895 Hinton Birch Cooley Census; 1899 James McLaughlin Census of Mdewakanton residing in Minnesota and 1924 James McLaughlin Census of loyal Mdewakanton; Twelfth Census of the United States of residents of the State of Minnesota and a listing of loyal Mdewakanton contained in the Congressional Globe, pp 514, dated January 26. The utilization of only the McLeod Census of 1886 and the Henton

Census of 1889 does not factually prove which descendents of the Mdewakanton Dacotah Sioux should be beneficiaries of the trust created by the Acts of the United States Congress, approved February 16, 1863 (12 Stat. 652, 654). 4. All censuses and official records of this period relating to the Mdwakanton

Dacotah Sioux residing in the State of Minnesota or removing to said State should be utilized as relevant indicators of who should be recognized as the beneficiaries of this lawsuit. [emphasis added]. 5. The areas held by the Minnesota Mdewakanton Dakota Sioux

Communities is approximately 950.75 acres, more or less in the Counties of Scott, Redwood, Dakota, Goodhue and Wabasha Counties of Minnesota (hereinafter referred to as "Trust Lands"), purchased pursuant to the Acts of the United States Congress, approved February 16, 1863 (12 Stat. 652, 654); May 15, 1886 (24 Stat. 29, 39-40); June 29, 1888 (25 Stat. 217, 228-229); March 2, 1889 (25 Stat. 980, 992-993) and August 19, 1890 (26 Stat. 336, 349), along with other monetary assets, which is now held in trust by the Defendant the United States on behalf of the Minnesota Mdewakanton Dakota Sioux Communities of Shakopee, Prairie Island and Lower Sioux. 6. The Defendant is the United States of America.

III FACTUAL BACKGROUND 7. Along the Mississippi River and the lower Minnesota rivers were the

villages of Mdewakanton, Wahpekute, Sisseton and Wahpeton Dacotah (Santee Sioux) in the early 1800's.

The lands of the Santee Sioux stretched along the Mississippi River in

Minnesota and Wisconsin and in mid-August of 1862 they were involved in an up-rising over a lack of food and other annuities. 9. The Santee Sioux consist of the lower Sioux, which are the Mdewakanton

and Wahpekutes and the upper Sioux who consist of the Sisseton and Wahpetons. 10. In the last days before the up-rising, several events happened that brought

the Santee to the point of war, one event outstands the rest and it was based upon the response to the Santee's request for food and when none was available, trader Andrew J. Myrick uttered the statement: " So far as I am concerned, if they are hungry, let them eat grass [or their own dung]." See, Folwell, History of Minnesota, II, at pg. 233. 11. Further, another incident on August 17, 1862, allowed for the hostilities to

ignite into a war, which involved what is now known as the Acton killings by four young members of a band that had seceded from the Shakoppe village. 12. And because of what the Santee perceived as the possible repercussions

and revenge based upon the Acton killings of five (5) whites a decision was made to go to war by certain Dacotah leaders. 13. The culmination of the 1862 up-rising was the hanging of 38 convicted

Dacotah Indians for their alleged participation in the war and the imprisonment of 350 or more men, women and children at Mankato and Fort Snelling, Minnesota, of which approximately 143 perished the first winter of their imprisonment. 14. The numbers in these two concentration camps varied throughout the

winter of 1862-1863, with approximately 342 prisoners at Mankato - all ­ Indians employed by the prison authorities. See, Mankato Weekly Report, March 7, 1863.

The other group contained 1,601 on December 1, 1862 and 1,591 on

March 10, 1863, of which 130 deaths offset by additions of captured Dacotah by military during the winter. See, Mankato Weekly Record, March 7, 1863. 16. At the time of the earlier census, the total included 295 upper Sioux, 133

Wahpekutes, and 112 half-breeds without tribal affiliations; the rest were Mdewakantons. See, Com. of Indian Affairs, Annual Report, 1863, pp. 313-316. 17. Certain leaders of the Mdewakanton, Wahpekutes, Sissetons and

Wahpetons did not actively participate in the up-rising of 1862, and when the 1,318 Dacotah were shipped out of Fort Snelling in May, 1863, 137 Dacotah were left behind to serve as scouts against the hostile Indians on the frontier. (See, Roy Meyer, History of the Santee (1993) ("History of Santee"), at page 259. 18. The Department of Interior in 1866 appointed Shubael P. Adams, to

investigate the condition of the Indians remaining in Minnesota and in that year, Adams found that there were 374 Santee Sioux living in Minnesota, including those at Big Stone Lake, who allegedly spent part of their time in Dakota Territory; 65 at Fairbault; 12 at Wabasha (most of whom had fled from Crow Creek that spring), 158 on the Yellow Medicine and at the scouts' camp about seventy miles south of there, and 139 at the head of the Big Stone Lake. (See, Roy Meyer, History of the Santee (1993) ("History of Santee"), at page 264-265. 19. 20. Of those more than one-half were mixed blood Indians. Further a removal of some of the loyal Santee Sioux occurred in July,

1867, to the Santee Agency Niobrara Nebraska.

In 1867 Samuel D. Hinman a protégé of Bishop Whipple a long time

supporter and caretaker of the Mdewakanton and other Santee Sioux sub-tribes traveled back to Minnesota from the Santee Agency to take a census of the remaining Sioux. 22. However, this proved difficult due to the moving back and forth between

the Missouri River and Redwood area by many of the Sioux that were counted by the census taken by Shuebal P. Adams in 1866. 23. Samual D. Hinman's census counted three lodges at Redwood Falls,

Minnesota; none at the upper Sioux agency as they had been ordered away to their reservation; seventy-five Sioux at Faribault, two at Mendota, four at Wabasha, and one lodge above Fort Snelling and John Bluestone who had bought a farm at Shakopee. (See, Roy Meyer, History of the Santee (1993) ("History of Santee"), at page 268. 24. When Hinman left in 1867 to return to the Santee Agency he left with four

lodges or thirty-nine individuals from the remaining Sioux communities in Minnesota. 25. Consequently, the population of Mdewakanton Dacotah Sioux in

Minnesota during this period was not static, but fluctuated immensely due to constant travel to and from different reservations. 26. Subsequent censuses were taken in 1886, 1889, 1890, 1892, 1899 and

1924 of the loyal Mdewakanton and their heirs, however, some individuals listed on the 1886 and 1889 censuses appear to have been imprisoned at Davenport, Iowa. (See, Exhibit(s) I , J, attached to the Original Complaint which are incorporated by reference herein). 27. Congress recognized the special circumstances of the loyal Mdewakanton

who did not participate in the 1862 up-rising and shortly thereafter passed the 1863

statute, which called for the Secretary of the Interior to set apart from public lands "eighty acres in severalty to each individual of the [Mdewakanton and Wapakoota] bands who exerted himself in rescuing whites from the late massacre [by] said [Sioux] Indians." Act of Feb. 16, 1863, § 9, 12 Stat. 652, 654. 28. The Act of 1863 also provided that "[t]he land so set apart . . . shall be an

inheritance to said Indians and their heirs forever." 29. However, this land grant was apparently not successfully implemented by

the Secretary of the Interior and consequently, the lands purchased by subsequent Appropriation Acts were acquired in the name of the United States, and a system of assignment was instituted by the Department of Interior. 30. Indian Land Certificates were then utilized to document the assignment of

these lands held by the United States for the benefit of the Mdewakaton(s) and their heirs and descendants and land was to be managed by the Department of Interior in the best interest of the trust beneficiaries. 31. The loyal Mdewakaton(s) who did not participate in the 1862 up-rising

accepted as best to their understanding and knowledge the mutual covenants of the consideration offered by the Untied States. 32. The expressed trust of the United States toward the loyal Mdewakanton's

is expressed in the subsequent Acts of Congress relating to appropriations and the purchase of certain lands pursuant to the Acts of the United States Congress approved Feb. 16, 1863, § 9, 12 Stat. 652, 654; May 15, 1886 (24 Stat. 29, 39-40); June 29, 1888 (25 Stat. 217, 228-229); March 2, 1889 (25 Stat. 980, 992-993) and August 19, 1890 (26 Stat. 336, 349).

In performance of said trust obligations the Untied States acquired the

1886 Lands in the Counties of Scott, Redwood, Dakota, Goodhue and Wabasha in trust for the loyal Mdewakaton(s). However, these lands should be identified as "1863 Lands" as well, as the original assignments to the loyal Mdewakanton Dacotah originated from the substantive provisions of said Act of the Untied States approved Feb. 16, 1863, § 9, 12 Stat. 652, 654 34. The trust corpus constitutes the 1863 and 1986 lands and certain monetary

appropriations and other personal property for and on behalf of the heirs and descendants of the loyal Mdewakton(s). 35. 36. The United States is the trustee of this trust obligation. The 1863 and 1886 lands were either assigned to a loyal Mdewakanton or

said lands were allowed to be leased by non-Indians, with the proceeds to be collected and paid over to the Mdewakantons and their heirs by the Defendant United States. 37. For nearly ninety years the property acquired and other properties and

monies generated from these specially appropriated funds were maintained in trust by the Defendant Untied States for and on behalf of the loyal Mdewakantons and their heirs the Plaintiff(s) in this action. 38. In 1980 during a lame-duck session of the United States Congress the

1863 and 1886 lands were transferred to three (3) Indian communities in trust, which had been formed pursuant to the Indian Reorganization Act of 1934 (also known as the Wheeler-Howard Act-codified in various sections of 25 U.S.Code). 39. Contained in the substantive provisions of the 1980 Act was a savings

clause which preserved the rights under any contract, lease or assignment entered into or

issued prior to enactment of this Act. See, 1980 Act, Pub. L. No 96-557, § 3, 94 Stat. 3263. 40. Pursuant to the savings clause contained in the 1980 Act the three (3)

Indian Reorganization Act - Indian Communities located in Minnesota took control over the 1863 and 1886 lands and have since that date collected and accumulated revenues. 41. The Defendant United States and Department of Interior has managed and

regulated said assets for the benefit of those Indian Communities in complete disregard for the rights and privileges of the loyal Mdewakanton(s) and their heirs. 42. Said actions by the Defendant, United States has violated and breached its

fiduciary duty and responsibilities to the Plaintiff(s) and their minor children. 43. Further, said breach of the Defendant's trust obligations has damaged the

Plaintiff(s) and their minor children.

IV CAUSE OF ACTION A. BREACH OF TRUST REPSONSIBILITY 44. The Plaintiff(s) hereby incorporate by reference each and every allegation

contained in paragraph(s) nos. 1 through 43 herein. 45. The Plaintiff(s) and their minor children are the heirs and descendants of

the loyal Mdewakaton Dacotah Sioux who did not participate in the 1862 up-rising and/or have ancestry that lived in the State of Minnesota or were removing to Minnesota during the relevant time period and thus, are the direct beneficiaries of the trust corpus created by the Acts of the United States Congress approved Feb. 16, 1863, § 9, 12 Stat.

652, 654; May 15, 1886 (24 Stat. 29, 39-40); June 29, 1888 (25 Stat. 217, 228-229); March 2, 1889 (25 Stat. 980, 992-993) and August 19, 1890 (26 Stat. 336, 349). 46. The Defendant United States by and through the Department of Interior

has the duty and responsibility to secure, maintain any and all assets of said Acts, including but not limited to the 1863 and 1886 lands in the best interest of the Plaintiff(s) and all trust beneficiaries. 47. The land assignment system clearly failed to fulfill the duties and

responsibilities of the trust obligations held on behalf of the beneficiaries and Plaintiffs(s) and further, the Defendant Untied States has failed to meet even the minimal standards as a trustee of said assets and lands. 48. The Defendant Untied States has failed to manage the 1863 and 1886

lands in a consistent manner to allow for the maximization of accumulated revenues, for and on behalf of the Plaintiff(s) as beneficiaries of the trust corpus. 49. The Defendant United States has allowed said assets and 1863 and 1886

lands to be placed in the ownership and use of others, which is in direct violation of said fiduciary duty owed to the Plaintiff(s) as beneficiaries of the trust corpus. 50. Presently and for many decades the Plaintiffs as beneficiaries have

received no use or benefit of the 1863 and 1886 lands and other assets contained within the trust corpus. 51. In addition, the Defendant Untied States has breached its fiduciary trust

obligations by allowing income, profits and proceeds from the 1863 and 1886 lands to be distributed those other than the Intervenor(s)/Plaintiff(s).
