Intervenors, for their Third Amended Complaint, state and allege as follows: JURISDICTIONAL STATEMENT 1. The Intervenors file this Complaint in the United States Court of Federal Calims pursuant to the jurisdiction provided in 28 USC §§ 1491, 1505, et. seq. The Intervenors claim an interest relating to the property or transaction which is the subject of the above-captioned action. Intervenors are so situated that the disposition of the above-captioned action may as a practical matter impair or impede the Intervenors ability to protect that interest. Intervenors seek to recover damages for Defendant's mismanagement of a trust created for their benefit and Defendant's breach of its trustee fiduciary duties. PARTIES 2. Plaintiffs brought this action on behalf of themselves and all other descendants of persons listed on the May 20, 1886 U.S. Mdewakanton census as trust beneficiaries of lands held in trust by the United States. Such lands are commonly referred to as the "1886 Lands." During the last few decades, the 1886 Lands have been developed with various for-profit establishments. 3. Defendant is the United States which holds in Trust the 1886 Lands to which the Plaintiffs and Intervenors are the rightful beneficiaries. 4. Intervenors are descendants of person/s listed on the 1886 U.S. Mdewakanton census as supplemented by the 1889 census. Thus Intervenors are trust beneficiaries of the 1886 Lands. Intervenors include minors whose parent/s, legal guardian or their next friends appear in this action on their behalf. 5. This Court's Opinion and Order dated December 16, 2005 provides that those individuals who claim to be descendants of the loyal Mdewakanton can appear in this action. Intervenors are descendants of person/s listed on the 1886 U.S. Mdewakanton census. FACTS 6. This Court's Opinions in this action set forth the history that resulted in the appropriations made by the United States to the Loyal Mdewakanton. Said appropriations included land and other provisions for the benefit of the Loyal Mdewakanton and their descendants. 7. The land provisions were land purchases by the United States that are held in trust for the Loyal Mdewakantons and their descendants. These lands are what is now referred to as the 1886 Lands. 8. The Intervenors are all descendants of the woman listed as Sarah Graham on the 1886 census and listed as Sarah Wakanhiyayewin on the 1889 census. The Intervenors possess documentation establishing that they are descendants of Sarah Graham/Sarah Wakanhiyayewin. Therefore, they are beneficiaries of the 1886 Lands that are held in trust by the United States.

9. The United States, as trustee of the 1886 Lands, has a continuing duty to manage the 1886 Lands for the benefit and in the best interests of all trust beneficiaries. Further, the United States has a continuing duty to ensure that any uses and benefits from the 1886 Lands be distributed fairly and equally among the trust beneficiaries. Finally, the United States has a continuing duty to make certain that only trust beneficiaries receive the benefits of the trust. COUNT I
TRUST MISMANAGEMENT & BREACH OF FIDUCIARY DUTIES

11. The United States, as trustee of the 1886 Lands, had and continues to have trust duties. Its trust duties include maintaining the 1886 Lands for the benefit of the Intervenors and other rightful beneficiaries of the trust. The trust duty includes managing the 1886 Lands in the best interests of the Intervenors and other trust beneficiaries. This duty also requires that the United States ensure that the use and benefit of the 1886 Lands be distributed equally among trust beneficiaries including the Intervenors. Finally, the United States is obligated to ensure that trust beneficiaries which include the Intervenors alone receive the benefits of the 1886 Lands including any and all revenue generated therefrom. 12. The United States breached its fiduciary duties related to the 1886 Lands it holds in trust for the loyal Mdewakantons and their descendants. 13. The United States breached its fiduciary duty by mismanagement of the 1886 Lands through its various land management policies. 14. The United States breached its fiduciary duty by failing to maintain the 1886 Lands for the benefit of all trust beneficiaries. 15. The United States breached its fiduciary duty by failing to manage the 1886 Lands in the best interests of all trust beneficiaries. 16. The United States breached its fiduciary duty by failing to ensure that trust beneficiaries share equally in the uses and benefits of the 1886 Lands. 17. The United States breached its fiduciary duty by allowing the uses and benefits of the 1886 Lands accrue to non-trust beneficiaries. 18. The United States breaches prevented the Intervenors from enjoying the uses and benefits of the 1886 Lands. 19. The United States breach of its fiduciary duties is the proximate cause of the Intervenors' damages which such damages are in excess of $10,000.

21. As provided by 28 USC §2412(b), parties who prevail against the United States are entitled to reasonable attorney fees and costs. 22. The Intervenors, if they prevail in their claim against the United States, further request an Order from this Court awarding reasonable attorney fees and costs against the United States and as permitted by law. WHEREFORE, the Intervenors respectfully request that the Court enter judgment as follows: 1. Entry of judgment for the Intervenors and against the United States as to Count I in an amount to be determined at trial including prejudgment interest; 2. 3.
