GOVERNMENT'S MOTION TO DISMISS COUNT ONE OF THE SUPERSEDING INDICTMENT AS TO DEFENDANT JAVIER E. AVITIA ONLY

COMES NOW, the United States of America, by and through its undesigned Assistant United States Attorney for the District of Colorado, and hereby moves, pursuant to paragraph I. A of its plea agreement with this defendant, to dismiss with prejudice the referenced count, showing unto the Court as follows: 1. On April 6, 2006, this defendant executed a plea agreement with the Government in which he agreed to enter a guilty plea to a one count information filed with leave of the Court in this case. It is anticipated that this plea agreement will be accepted by the Court at the sentencing hearing in this matter on Friday, June 16, 2006. 2. At the conclusion of the sentencing hearing, the Government intends to move for the dismissal with prejudice of the referenced count as to this defendant only and has prepared a proposed Order for the Court's consideration in this regard.
