General Instructions For Responding To An Investigation Report
Your claim against the state will be determined by the Clerk of Court of Claims. To assist the Clerk in this determination, Ohio law requires that the state department, board, office, commission, agency, or institution whose actions are the subject of the claim must investigate the claim and report the results of the investigation to the Court by filing an "Investigation Report". The Investigation Report for you claim has been filed and a copy in included herewith. You have the right to respond to the Investigation Report. Your response must conform to the instructions set forth below. TIME FOR FILING RESPONSE Your response and one copy thereof (including any attachments) must be received by the Clerk within twenty-one (21) days after you receive the Investigation Report. You must request an extension of time in which to respond to the Investigation Report. A request for an extension of time must be in writing and must be received by the Clerk within twenty-one (21) days after you receive the Investigation Report. The request must set forth your reasons for the extension. You will be promptly notified of the disposition of a request for an extension of time. FORMAT OF RESPONSE The response to the Investigation Report shall be submitted on 8½ by 11" paper. Typewritten responses are preferred; illegible responses will be ignored. The attached form is provided for your use as the first page of your response. Use both the front and back of this form. If you need additional pages, use 8½ by 11" paper. The top 1" to 1½" of the additional pages should not be used, nor is a heading required on the additional papers. Use only the front of all additional pages submitted. You must sign your "Response to an Investigation Report": at the end, under the last sentence on the last page of your "Response". CONTENTS OF RESPONSE Your response to the Investigation Report should be divided into two main sections: first, a reply to the Investigation Report; and second, any additional information which you feel is relevant to your claim. In the reply section, indicate those segments of the Investigation Report with which you agree; then indicate those segments of the Investigation with which you disagree, and explain the factual basis of your disagreement. You may attach pertinent witness statements, depositions, affidavits, contracts, internal investigation reports, police reports, maps, charts, diagrams, photographs, etc., to your "Response". To the extent that any portion of your response or attachments thereto rely upon the testimony of a person not a party to your claim, you must state that person's name and address.
