A hearing was held on the record on Wednesday September 5, 2007, to address whether the August 2, 2007 Affidavit and attached exhibits of former counsel for the plaintiff should be filed under seal.1 After discussion, and with agreement of the
parties, it was agreed that the plaintiff did not seek to have the exhibits attached to the affidavit disclosed to him and that the exhibits would be available to Judge Hall for her consideration in ruling on the defendant's motion for summary judgment. Pursuant to Rule 5(d)3, D. Conn. L. Civ. P., the Affidavit of Attorney Jonathan B. Tropp Dated August 2, 2007 and the
Counsel for the defendant, Steven R. Strom, Former Counsel for the plaintiff, Jonathan B. Tropp appeared in person for the hearing and plaintiff participated via telephone.
