grant an enlargement of time to January 7, 2003 to tile a reply brief to defendant’s
motion to strike afhdavits in this matter. This is the iirst request for enlargement of time N

Procedural Baclgground
- The plaintifti Mario Richards, commenced this action on April 7, 2003 pursuant N
to the Fair Labor Standards Act, 29 U.S.C. 201 et seq. (FLSA), claiming wages for N
N overtime hours worked in excess of forty hours per week. The parties tiled a Rule 26 (i) N
N report and a scheduling order was entered by the court (Squatrito, J .). The plaintiff iiled
a motion for class certification with memorandum and a reply brief with accompanying N
affidavits. On December 10, 2003 the defendant tiled a motion to strike the plaintiffs N
supporting atiidavits. N
