1. This is an action for a declaratory judg ent, an injunct on, and actual,
statutory, and punitive damages and attorneys feeI for violation 0 l5 U.S.C. § 1601, et I
seq.(TILA), and for actual, minimum and punitive damages for v ola1tion of the Motor
Vehicle Infomation and Cost Saving Act ( OdorrIeter Law), 49 `.S.C. 32701 et seq.
and Conn. Gen. Stat. § 36a-676 et seq.; and for aIItual and puniti e damages pursuant
to Conn. Gen. Stat. §42—1 10a et seq.
2. Jurisdiction is conferred on this Court dy 15 U.S.C. § 1 01 et seq. and 28
U.S.C. § 1331 and §1367.
3. Plaintiff is a resident of Connecticut. I
4. Defendant Ludwig’s Auto Sales, LLC iI; a limited liabi ity company with a I

5. Defendant Paula Antonucci d/b/a Lud yig’s Auto Sales is a company with a 1
place of business at 395 Dixwell Ave., New Havein, CT 06511. 1
6. Defendant Source One Financial Corp. 1is the assignee f the consumer retail
installment contract and authorized to do busine%s in the State o t Connecticut by the I
Secretary of State. 1
7. On or about December 17, 2002, plainti1f entered into a consumer credit
transaction with defendant Paula Antonucci d/b/alLudwig’s Auto Sales and/or
Ludwig’s Auto Sales LLC, which was later assig ed to Source O e Financial to
finance a 1997 automobile for personal, family 01 householdl use.
8. At all times herein, all defendants in the 1ordinary course of business regularly
extended consumer credit.
9. Defendants are creditors within the mezining of C.G.S. 3621-676, et seq. and
15 U.S.C. § 1601, et seq. and regulations promuléated thereunde .
10. Defendants failed to provide the infonination required to be disclosed by 15
U.S.C. § 1601, at seq. or C.G.S. § 36a-676, et sari. and the regul tions thereunder at or E
prior to consummation of the transaction. I
11. The violations of the federal and state 1truth—in—lendin laws appear on the
face of the retail installment contract.
12. Plaintiff has suffered and will suffer nionetary loss, e barrassment, stress
and inconvenience as a result of defendants actioiis. 1

_ 14. Defendant Paula Antonucci d/b/a Ludwigs Auto Sales d Szource One i
Financial Corp. violated the Odometer Law in their defendants iss ed to plaintiff an
odometer statement which it knew was false or hid reason to kno was false, or (b) 1
defendant did not issue an odometer statement to plaintiff.
15. Defendant so acted with intent to defriaud plaintiff.
16. Plaintiff has suffered and will suffer nionetary loss, e barrassment, stress
and inconvenience as a result of defendants actioriis.

18. All defendants have committed one orimore unfair or eceptive acts or
‘ practices in violation ofthe Connecticut Unfair Tiade Practices ot § 42-1 10a Conn.
Gen. Stat. et seq., including, but not limited to fai`ing to disclose o plaintiffs the
accurate financial terms of the transaction, failingpto provide plai tiff with a copy of
the Retail Installment Contract, failing to provide iplaintiff with a uy/sell agreement, 1
failing to provide plaintiff with a bill of sale, eliciiing his agreem nt to the transaction N

19. Plaintiff has suffered and will suffer sbvere monetary loss, embarrassment,

stress and inconvenience as a result of all defendants actions.
WHEREFORE, it is respectfully prayed that this Fourt: I
1. Award twice the finance charge in connectibn with the con ·. umer credit ·
transaction, and actual damages, pursuant to 15 Ll.S.C. §l60l1; N
2. Award plaintiff three times the actual damages or $1,500.0 I whichever is
greater, under the Odometer Law, together with +:0sts and attornr fees on Count II. I
3. Award actual damages, and punitive damagles to plaintiff p rsuant to Conn. Gen. =
Stat. §§42-1 10g on Count III.
