DEFENDANTS' MOTION TO DISMISS THE SECOND CONSOLIDATED AMENDED CLASS ACTION COMPLAINT On March 1, 2006, the Plaintiffs filed their Second Consolidated Amended Class Action Complaint ("Complaint") (dkt. # 55). Pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, and for the reasons set forth in the accompanying motion memorandum, the Defendants hereby move for dismissal of the Complaint with prejudice for failure to state a claim upon which relief can be granted.
