I Plaintiffs’ want to file a sprreply memorandum in p rt because theyI believe I
I the Defendant both inaccurately mischaracterized some f the cases that Ithe
I Plaintiff cited in its reply memorandum and the Plaintiffs ants to critique $evera|
of the new cases cited by the Defendant in its reply mem randum.
The Defendant’s second argument is illusory claimi g that this court needs
to decide the motion to transfer before a February 13, 200 court date with Judge
Pauley in New York. It appears as if Judge Pauley is only aving a scheduling
conference on February 13, 2004. Thus there are several easons why thaIt date
is irrelevant to Plaintiffs’ request to file a surreply; 1. On th t date it only apI>ears
to be a scheduling conference. The Defendant indicates it s only "to determine I
the future course of the proceedings? Thus that in and of i self would not sIem to I
l require that our District Court in Connecticut decide the IVI ion to Transfer In _
advance of that date; 2. It obviously mean the New York c se will not really be I
significantly progressing on that date itself; 3. By allowing t e Plaintiffs to file a
surreply and even file it by January 7, 2004 would still give his court a I
reasonable lead time to make at decision before the February 13, 2004 assuming I

conceivable the Plaintiff could file a reply by December 31, 2003 although
counseI’s scheduled surgery islstill being delayed by an l sue of an infection and
I a potential blood clot. As of this undersigned writing but u able to sign this Reply
