MOTION FOR CONTINUANCE I
The undersigned Respondent, William L. Ankerman, represents as
follows: E
1. Respondent was convicted on April 12, 2002, for violation of General
Statutes Secs. 53a0122 and -119(2).
2. 0n June 7, 2002, Respondent was sentenedd to the custody of the Commissionerat A
Correction for a term of three years, execution suspended after six months, but
remained at liberty on an appeal bond until November 17, 2004, when he
entered into custody.
3. Respondent remains in custody, but is eligible for release on or after
April 25, 2005.
4. Respondent has received notice indirectly, at his home address, in West
Hartford, that a Show Cause Hearing has been set in a/presentment against him
on the basis of the aforesaid convictionqifbr April 25, 2005, at 10:00 am, New
Haven District Courtt
5. Respondent has not received notice of any actual date of release on this
sentence, s%’absent the issuance of a writ of habeas corpus, he may be unable to
attend this hearing.
6. Respondent is appearing pro se in this presentment. A
7. ‘ Respondent's files and law_books are unavailable to Respondent}while
incarcerated, for use inpreparing for this hearing.

- Respondent William L. Ankerman, further represents:
1. Mere conviction of a "serious crime,"“gyeg_a Connecticut felony, is noi Q
basis, ipso factor for disciplinary action under the Local Rules of the `
Federal District Court of Connecticut. j
2. The subjecJZ conviction in the state court, even though unsuccessfully
appealed, was so fraught with constitutional defects that it amounts to a N
_ miscarriage of justice_and a civil rights deprivation. State v. Ankerman, l
81 Conn. App. 503, A.2d , 270 Conn. 901, A.2d 1
] , cert. den.,- U. S. (October 18, 2004).
3. The constitutional defects include, but are not limited to : i
a. Ineffective assistance of counsel and E
b. Discovery of new evidence. i
H EREFORD, Respondent moves that the Show Cause Heating now set for April 25, g
2005, 10fOO amfbe continued to May 22, 2005, or to such later date as the `
Court sees fit.
RESPONDENT ALSO MOVES that the date for filing of an original answer and one _
