IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that the sum needed to equalize the share of Husband, to wit: $4,279.35 shall be paid by wife signing a promissory note in the amount of $4,279.35,on or before five days following the signing of this Judgment, said note shall be secured by the execution of a mortgage encumbering _____________________, which mortgage shall also be executed within five days of the signing of this Judgment. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that the cost of the appraiser of the immovable property in the amount of $300.00, and the appraiser of the movable property in the amount of $200.00, and the costs of the proceedings, shall be paid by both parties' payment of one-half (1/2) of the total of such costs. ADDITIONAL ASPECTS OF THE JUDGMENT ON THE MERITS
1. In the event there are retirements, the Judgment should also provide: IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that a Qualified Domestic Relations Order shall be presented to the Court, recognizing the interest of _______________________ in the ___________________ (retirement plan), within ten (10) days of the signing of the Judgment. 2. In the event there is to be a private sale property, specific terms should be set, e.g., the names of the realtor or if movable property , agent selling the property or if it is one of the parties, the listing price, how the price is to be determined, the duration of the listing agreement, or attempts to sell. The requirement that the listing agreement be renewed unless good cause can be shown to the Court why another agent should be selected, and a method by which the parties will agree to a lesser figure that the listing price if they cannot agree on a reduction. The Court should retain jurisdiction until the final allocation can be made following the sale(s).
