This notice is required to be sent to you by local court rules to provide you with information about Probate Court. It does not mean that you will receive part of this estate.

You may attend court hearings, if you wish. You will not receive notice of future court dates for a petition, if the hearing is postponed. You may not received any notice of future petitions. However, you may request to be notified by filing with the Court and serving on the personal representative a form entitled "Request for Special Notice". You are entitled to examine the file to determine what occurred or to learn of a new court date.

If you object to the court action requested in any petition, such as the acceptance of a will, the appointment of a particular person as the personal representative to manage the estate (the Executor of a will or the Administrator when there is no will), or the waiving of a security bond, or an account, or report, it is necessary for you to present your objection at the hearing. You may object by appearing in court or by serving and filing a written objection in the manner required by law.

The personal representative is required to file an inventory of estate assets within four months after the appointment and to file a petition for distribution within 12 to 18 months after appointment, or to file a report on the status of the estate explaining why it can not be distributed.

The court's file is a public record and may be examined. Heirs (those who receive the estate if there is no will) and devisees (those who receive the estate under a will) have certain rights under the California Probate Code, including the right to obtain information regarding the estate administration. The personal representative, or the representative's attorney, may voluntarily provide information, or it necessary, you may petition the Court to obtain information or to enforce your rights.
