LEGAL RIGHTS AND COURT PROCEDURES ­ MINOR OFFENSES
Under the law, you have the following rights: 1. To remain silent. You do not have to make any statements or answer any questions. Any statements you make can be used to prove the case against you. 2. To be informed of the charges against you. 3. To be represented by your own attorney at all stages of the proceedings. 4. To have a continuance if you need one to consult an attorney, to decide how you wish to plead or for other good cause. 5. To a public and speedy trial by judge or magistrate without a jury. 6. To be presumed innocent until you are proven guilty. At trial, the prosecutor must prove you guilty beyond a reasonable doubt. 7. To have subpoenas issued for witnesses to compel their attendance at trial. 8. To be confronted by witnesses against you at the time of trial and to question those witnesses. 9. To present relevant evidence and testify in your own behalf. 10. To appeal an adverse decision to a higher court. You may enter a plea of GUILTY, NOT GUILTY or NO CONTEST to the charge against you.

If you plead GUILTY or NO CONTEST, 1. you will not get a trial, and 2. you will give up the rights listed on the other side of this form, and 3. a judgment of conviction will be entered against you. The maximum fine that can be imposed for most minor offenses is $300. The court will advise you if the maximum possible penalty for your offense is different. 4. If this is a traffic case, points may be assessed against your driver's license. If you accumulate 12 points within 12 months or 18 points within 24 months, the Division of Motor Vehicles will suspend your driving privileges. 5. If this is a fish and game case, any fish, game or equipment seized and listed on the face of the citation will be forfeited to the State of Alaska. Also, if you have a prior conviction for a fish and game offense, an action may be filed to revoke your license under AS 16.05.410(g). A plea of NO CONTEST may not be used in a civil suit against you to show that you did the acts charged in the citation. However, the NO CONTEST plea will result in a judgment of conviction against you on this citation.
