Out-of-State Child Custody and Parenting Time Judgments Information on Registration of an Out-of- State Judgment
An Oregon court may enforce or modify a judgment or order from another state if one party is located in Oregon and registers the judgment with the Oregon court. ORS 109.787

Process for Registering an Out of State Judgment
File the following papers with the Circuit court: ·A letter requesting registration ·Two copies (one must be certified) of the out-of-state judgment or order. ·A sworn statement that the order or judgment has not been modified and information regarding the custodial status of the child(ren).

Complete Service: You must have the other party served with the following documents: ·The attached Notice of Registration ·A true copy of the judgment or order you are registering ·A true copy of the affidavit you filled out above You may use the Sheriff's office or a process server to complete this step. You CAN NOT SERVE the documents yourself.

Confirmation of the Registered Order or Judgment: Your registration is confirmed after 21 days have passed from the date of service if the party served does not request a hearing. A notice of Entry of Judgment will be mailed to each party. If a hearing is requested by the other party, the court will hold a hearing to decide whether the registered order or judgment will be confirmed.

After the confirmation of the registered order or judgment, you may request the court to enforce or modify the registered order or judgment by using either the custody or parenting time enforcement packets or modification packets. These packets are available for a small fee to cover the cost of copying the documents at the Linn County Courthouse, Room 107, or online for no cost at www.ojd.state.or.us/linn.
