No. 98-168C (Filed: April 14, 2008) __________ NORTH STAR ALASKA HOUSING CORPORATION, Plaintiff, v. THE UNITED STATES, Defendant. _________ ORDER __________ Based on the opinion and order filed in this case on March 7, 2007, as well as the parties' joint status report proposing judgment amount filed on May 4, 2007, and defendant's filing of incentive fee decisions on June 21, 2007 ­ 1. The Clerk is ordered to enter judgment for the plaintiff in this case in the followings amounts: a. For the fire that occurred at 765 Bataan Court on August 23, 1996, $15,695.63, plus interest on that amount as provided in the Contract Disputes Act (CDA), calculated from September 12, 1996; For rent reductions based upon alleged excess downtime for February through June 2002, $7,506.33, plus interest on that amount as provided in the CDA, calculated from September 4, 2002; and For incentive fees for contract performance year 1998, $56,667, plus interest on that amount as provided in the CDA, calculated from March 29, 1999.

The court declares that plaintiff is entitled to receive the following incentive fees: a. For incentive fees for contract performance year 1999, $55,437, plus any interest as provided by law;

For incentive fees for contract performance year 2000, $52,835, plus any interest as provided by law; and For incentive fees for contract performance year 2001, $53,614, plus any interest as provided by law.

Nothing herein, or in the parties' agreement that partially led to the entry of this judgment, shall be construed as waiving any rights, including to appeal and the right to seek recovery of additional monetary amounts based upon the court's declaratory rulings here and in the prior opinion. IT IS SO ORDERED.
