PLAINTIFF'S STATUS REPORT REGARDING PENDING REEXAMINATION PROCEEDING

Pursuant to the Court's Order of August 15, 2007 in Cause No.: 03-cv-02223-JLK-BNB, Plaintiff files this status report on the status of the pending reexamination proceeding relating to the patent-in-suit in this infringement actions. On December 4, 2007, the United States Patent and Trademark Office ("USPTO") issued its Initial Office Action relating to the pending reexamination. In this Office Action, the examiner made the initial decision to reject all of the claims. The patentee elected not to respond to an earlier request for reexamination and now has

a two month statutory period to file its response to the Office Action, which is Monday, February 5, 2008. Upon a showing of good cause, the USPTO typically approves a one month extension of time. At this time, the patentee has not yet determined whether it will seek an extension of time in which to file its response to the Office Action. While there is no statutory deadline, following the filing of a response, the examiner issues a new communication which is usually a final office action or a notice of intent to issue an ex-parte reexamination certificate. This typically occurs within 2-4 months of the filing of a response. In addition, the patentee can request a personal or telephone interview with the examiner and such interview, if allowed, is conducted prior to the filing of the response.
