MOTION FOR ISSUANCE OF CONTEMPT CITATION Plaintiffs, the Trustees of the Carpenters' and Millwrights' Health Benefit Trust Fund, Trustees of the Centennial State Carpenters' Pension Fund, Trustees of the Colorado Carpenters' and Millwrights' Vacation Trust Fund, Trustees of the Centennial State Carpenters' Pension Trust Fund Annuity Plan, and Trustees of the Colorado Carpenters' Joint Apprenticeship Trust Fund, (collectively the "Trustees"), by and through their attorneys, move the Court for the issuance of a contempt citation as follows:

Following an evidentiary hearing held on January 28, 2005 and pursuant to the

Recommendation of United States Magistrate Judge, the Court entered Judgment on March 31, 2005 against Defendants Leon D. Scott, Occia S. Scott and Leon D. Scott and Occia S. Scott dba cts oce C n at ( lcvl " e nat ) // So 'C nrt ot c rc l t e D f dn ". t e r o oe i y e s 2. The Court entered judgment in favor of the Trustees and against Defendants in

the amount of $32,927.98. 3. The Court also ordered Defendants to produce certain documents and materials

was April 15, 2005. 5. 6. Defendants failed to produce any documents on April 15, 2005. In a letter dated April 28, 2005, the Trustees requested that Defendants produce

the documents by May 11, 2005 in order to avoid contempt proceedings. Defendants did not rsod o h Tut slt . epn t t rs e'ee e e tr 7. On May 23, 2005, the Trustees filed a Motion for Order to Show Cause

informing the Court that Defendants failed to produce the documents as ordered.

On July 21, 2005, the Court entered an Order to Show Cause ordering

Defendants to show cause in writing on or before August 12, 2005 why they should not be hl i cn m to f l eo o p wt t C ut Jdm n e n ot p frau t cm l i h ors ug et d e ir y h e ' . 9. Neither the Trustees nor their counsel received a response from Defendants on
