MOTION TO WITHDRAW

Troy A. Eid, United States Attorney for the District of Colorado, and Roxane J. Perruso and Amanda Rocque, Assistant United States Attorneys, move this Court for an Order allowing them to withdraw from this action, on the following grounds. 1. On March 14, 2005, the above-named counsel entered an appearance in this

action on behalf of the Secretary of the United States Department of Agriculture (the "USDA"), for the limited purpose of filing a motion to quash a subpoena dated March 16, 2005, which commanded an employee of the USDA Forest Service, Steven B. Hartvigsen, to testify and produce documents in the above-captioned case. 2. On November 10, 2005, after briefing on the motion was complete, the

Court issued an Order granting the USDA's motion to quash.

The USDA has no other role in the above-captioned litigation; therefore, its

counsel request they be allowed to withdraw. WHEREFORE, Troy A. Eid, United States Attorney for the District of Colorado, and Roxane J.
