This is a continuance of the Evidentiary Hearing on Monday, February 4, 2008. Defendant Charles Lewis, is present in court (on bond). Defendants George Weed and Michael Smith appear via telephone. Defendants Norman Schmidt and Jannice Schmidt are present in court (in custody). Appearances of counsel. Counsel, Peter Bornstein, Thomas Hammond, and Thomas Goodreid appearances have been waived.

Agent Stephanie Hahn resumes the witness stand. The witness is reminded that she remains under oath. 9:08 a.m. Re-direct examination of the witness, Agent Stephanie Hahn.

The witness is excused. It was ORDERED: 1. That the Court will issue and enter its written order addressing and resolving the issues raised by and inherent to defendant Jannice McLain Schmidt's, Motion to Preclude the Government from Breach of the Plea Agreement. That the Court will resolve all pending objections to the exhibits offered by the Government during the three days in which this evidentiary hearing has been conducted. That the Court will direct and require the probation department to complete all presentence investigations and file presentence reports. That the Court will set individual sentencing hearings for each of the defendants, commencing with defendant Norman Schmidt.
