ORDER FOLLOWING EARLY NEUTRAL EVALUATION CONFERENCE AND SCHEDULING CASE MANAGEMENT CONFERENCE

On August 29, 2008, the Court held a telephonic Early Neutral Evaluation conference. Brian Miller, Esq., and Christopher Hayes, Esq., appeared as counsel for Petitioners; Tom Ryan, Esq., and Laura McLane, Esq., appeared as counsel for Respondents. The case did not settle. Presently the parties are briefing Petitioners' ex parte application for an order to enforce the subpoena that is the subject of this litigation. Petitioners' application will be heard by the Honorable Jeffrey T. Miller. A Case Management Conference shall be held on September 23, 2008 at 1:30 p.m. That conference shall be telephonic, with attorneys only. Counsel for Petitioners shall arrange and initiate the conference call. DATED: September 3, 2008
