PROCEDURES FOR TRADEMARK REGISTRATION
This information is intended to aid in the completion of the trademark registration form provided by the Oklahoma Secretary of State's office. Title 78 of the Oklahoma Statutes applies to all trademarks and labels. PLEASE CONSULT THE STATUTES CAREFULLY. The availability of the proposed trademark name and/or design may be checked prior to registration by telephoning the TRADEMARK DIVISION of the Secretary of State's office at (405)-521-3912. Documents to be PROCESSED in person must be delivered to the Secretary of State's office between the hours of 8:00 a.m. and 4:00 p.m. (Monday-Friday). 5. A trademark shall be effective for an initial term of ten (10) years from the date of registration (Title 78, '25).

INSTRUCTIONS 1. TRADEMARK NAME AND/OR DESIGN: The term "trademark" means any word, name, symbol, emblem, or device or any combination thereof adopted and used by a person to identify goods made or sold or services rendered by him and to distinguish them from goods made or sold or services rendered by others. If the trademark is to be a design, you must give a description of the design. 2. 3. DESCRIPTION: A brief description of the goods or services the mark is used in connection with. MODE: The mode or manner in which the mark is used in connection with the goods and services.

4. CLASSIFICATION: General classes of goods and services (listed on reverse side of this form) are established for convenience of administration of Title 78, but not to limit or extend the applicant's or registrant's rights. A single application for registration of a trademark may include any or all goods upon which or services with which the trademark is actually being used indicating the appropriate class or classes of goods or services. When a single application includes goods or services which fall within multiple classes, the Secretary of State shall require payment of a fee for each class. 5. DATE OF USE: The date when the trademark was first used anywhere and the date when it was first used in Oklahoma by the applicant or his predecessor in business. 6. APPLICANT'S NAME: The term "APPLICANT" embraces the person filing an application for registration of a trademark under Title 78, his legal representatives, successors or assigns. The term "PERSON" means any individual, firm, partnership, corporation, association, union or other organization. 7. 8.
