1. 1.. The above-captioned action was commenced by Plaintiff in the Superior
C 2 Court of the State of California, County of Santa Cruz on or about April l0, 2007. A
3 true and correct copy of the Summons and Complaint are attached hereto as Exhibit
4 “A.."
5 2. Service ofthe Complaint on Reliance Standard was made on April .23,
6 2007.
5 7 3. This action relates to a-claim for benefits under Reliance Standardls group
8 long term disability insurance policy.
9 4. The policy was established and maintained by plaintiff' s former employer
l 10* as an employee welfare benefit plan.
S 11 5. The plan requires all employees ofthe policy holder to participate in the
l 12 coverage and further requires the policyholder to pay all premiums.
13 6. This plan is therefore subject to and governed by the provisions of the l
’ g gc § 14 Employee Retirement Income Security Act of 1974 ("ERlSA"), 29 U.S.C. §§ l00l et.
t g 15 seq.
g 16 7. A cause of action filed in state court seeking recovery of benefits under
g E 17 an employee welfare benefit plan is removable to federal court pursuant to 28 U.S.C.
_ 18 §l4-4 l(c), as an action arising under a federal law. See Metropolitan L-rfa Insurance
19 ·Compczrty v. Taylor, 481 U.S. 58 (1987); Pilot Life Insurance Company v. Dededoux,
l 28 481 U.S. 4l (1987).
21 8. This United States District Court has original subject matterjurisdiction
22 over this action pursuant to 28 U.S.C. §I331 and 29 U.S.C. §l l32(e) and, as a civil
23 ‘ action founded u_pon a claim of right arising under the laws of the United States, this
24 action may be removed to this court pursuant to the provisions of 28 U.S.C. §l44l (a),
25 (b) and (c).
_ 26 9. Defendant Reliance Standard is informed and believes that plaintiff is a
27 California citizen.

I 10. Defendant Reliance Standard was, at the time ofthe filing of this action
J 2· and at the time of removal is a corporation inthe State of Illinois with its principal
i 3 place of business in Pennsylvania.
4 li. There is complete diversity of citizenship between plaintifi on the one
i 5 _ hand, and defendant, on the other hand, such that removal is proper pursuant to 28
6 ` U.S.C. §i446(b).
. 7 I2. This action is also being removed pursuant to 28 U.S.C. §l332. The
4 S amount in controversy exceeds $75,000.00 because plaintiff seeks damagesfor breach
9 of contract, breach of
10 the covenant of good faith and fair dealing, fraud/misrepresentation, violation of
I1 Business and Professions Code Sections 17100, er. seq., and negligence. Plaintiff also
§'§, I2 seeks punitive damages, atto1ney’s fees and costs.
13 13. This Notice of Removal is being tiled within thirty (30) days- of
