23 3. In September 1997, Century 21 entered into a Franchise Agreement with §
2 4 Daryush Motlagh which permitted Motlagh to operate as a Century 21 franchisee. [
2 5 4. Motlagh operated his real estate business under the name "Century 21 1
2 6 Assurance Realty." l

1 5. The Franchise Agreement required Motlagh to pay Century 21 fees totaling
2 8% of the gross revenue earned, derived or received by Motlagh or his affiliates in -
3 connection with his real estate business.
4 6. Century 21 franchisees are required to report their revenue to Century 21
5 and make the payments required by the Franchise Agreement on a monthly basis. c _
6 7. Motlagh has not reported any revenue or made any payments to Century 21
7 since February 2002.
8 8. From December 27, 2001 to the present, Motlagh and his business Integrity
9 Assurance, Inc. have made only two payments to Century 21 totaling $1,068.67. Motlagh p

10 or Integrity made these two payments in January and February 2002. A true and correct `_
ll copy of a computer print out documenting those two payments is attached.
12 9. Motlagh and Integrity have made no further payments to Century 21 since ·
13 December 27, 2001.
