The Court advises the parties that the trial set in the abovestated cases cannot commence on 10/20/05 as previously scheduled due to the Court being in trial in another matter that date. Discussion held. IT IS ORDERED vacating Trial on October 20, 2005, in the above-stated cases. New trial date discussed. Trial may be set the week of 11/14/05 or in the first few weeks of December. Plaintiffs Mullins and Diaz advise if trial is scheduled in December that it will result in their inability to purchase food at the store located in the prison. Discussion held. The Court directs defense counsel to file a notice with the Court to advise if the above-stated issue has been addressed and resolved. The Court suggests when the above-stated cases are re-set for trial that CV 03-1393 PHX SRB (Baptisto v Ryan) be scheduled the same date and time as it raises the same two issues. Discussion held. The Court directs defense counsel to enquire of the Bureau of Prisons if the simultaneous scheduling of three prisoner cases will be a security issue.
