MEMORANDUM OF POINTS AND AUTHORITIES On September 13, 2005, Defendants filed a Suggestion of Death upon Record pursuant to F.R.C.P. 25(a)(1) suggesting that the only Plaintiff in this matter, Kenneth

Brian Denzine, is deceased. Fed. R. Civ. P. 25(a)(1). A hearing was promptly set for September 27, 2005 at which time Plaintiff's counsel, Sabinus Megwa, provided the Court with a copy of a Certificate of Death verifying that Kenneth Brian Denzine died on August 4, 2005.

Pursuant to F.R.C.P. 25(a)(1) any party wishing to substitute in as the Plaintiff in this matter would be required to file a Motion for Substitution within 90 days of the filing of the Suggestion of Death; otherwise the action must be dismissed as to the deceased party. Fed. R. Civ. P. 25(a)(1). The prescribed 90 day period expired on

December 12, 2005. Following the hearing on September 27, 2005, Plaintiff's counsel indicated that he would know within 10 days whether a Motion for Substitution would be filed. The letter, attached to this Motion, was sent to Plaintiff's counsel on October 11, 2005 and memorializes that conversation. As of the date of this filing, there has been no Motion for Substitution filed and no response to the October 11, 2005 letter or other information provided indicating whether there will be a Motion for Substitution filed. At the September 27, 2005 status hearing on this matter, the Court set another status hearing for Monday, December 19, 2005 to determine whether this matter will proceed.
