Plaintiff/Counterdefendant Ammar Halloum hereby moves this Court to order

21 and issue a subpoena to a witness who lives outside the 100 miles limit, and who
22 refused to accept the subpoena. Process server for Plaintiff had served a subpoena on
23 Carla Minnard, who lives and work in San Francisco; however Mimiard refused the
24
I 25 subpoena alleging that she was not properly served since she lives outside the 100
26 miles limit. Minnard, who is an attorney, was previously employed by Intel to be an
27 expert witness in the Whistle blowing case, and her testimony is crucial in this case.

1 Plaintiff wants to subpoena Minnard to testify, and will pay the witness for her time a
2 reasonable cost that this Court will find appropriate.

5 Plaintiff respectfully requests this Court to urgently order the witness to
6 appear in the Trial at 10:30 am on June 2, 2006 for her testimony as a witness.
