8 undersigned, submits the following comments regarding the case status and re-trial 9 regarding damages. With respect to the two alternatives proposed by the Court, Marlyn 10 11 requests a jury trial on the damages in connection with its Lanham Act false advertising, 12 unfair competition and trade libel claims. A designation of the record should be

13 submitted by the parties, as the court suggests, first by Marlyn, then World Nutrition, and 14 then Marlyn. With respect to the compensatory and punitive damages, the jury should be 15 instructed that it must award both compensatory and punitive damages. In the 16 17 alternative, the Court should award punitive damages in the minimum amount of 18 $3,000,000, or in the same ratio that the original punitive damages award bears to the 19 compensatory damages awarded by the original jury. It would be grossly unfair and 20 unjust to deny Marlyn the same amount of punitive damages or the same ratio of punitive 21 22 damages in a re-trial, where it is virtually impossible to replicate the factual support for 23 the award of punitive damages made by the first jury. Marlyn will be unfairly prejudiced 24 by simply reading to the new jury portions of the record, without the benefit of seeing the 25 witnesses' demeanor, bias, etc. that undoubtedly impacted the first jury when it rendered 26 27 the verdicts. 28
