As neted in eur eppesitien, the District Ceurt is empewered under 20
0.s.C.A. §l406 te transfer this matter in the interest ef justice. 28
0.S.C.A. §ld06(a) states:
The district court ef a district in which is filed a case laying venue
in the wreng divisien er district shall dismiss, er if it be in the
interest ei justice, transfer such case te any district er division in
which it ceuld have been breught.
The interest ef justice respectfully requires that this matter be
transferred rather than dismissed.

deserve justice as it argues that it is not in the interest ef justice
te permit a claim against defendant in any ferum. While ene party’s
perceptjen of justice may differ frem another’s, defendant articulates
ne reasen fer why its perception ef justice it inherently superier te
any ether.
F.R.Cv.P. 4l{b) states that an inveluntary dismissal based en
impreper venue dees net act as an adjudicatien on the merits. Hewever,
as argued befere, sheuld the ceurt grant defendant's pending motion te
dismiss, that will be the result. The statute el limitatiens in this
matter ran en February 2, 2007. An eutright dismissal weuld, in fact,
act as an adjudicatien en the merits ef plaintiff’s claim as he weuld
be time—barred from refilling in anether ceurt. That is net what the
rules intended when dismissing a case fer impreper venue.
It is respectfully submitted that plaintiff has as egual a claim
te justice as defendant. The law recognizes that transferring a ease
te a different venue is a viable alternative te a dismissal in the

interests ef justice. 28 U.S.C.A. §l406{e). It is respectfully
