4.

For the reasons set forth in the Moving Defendants' Memorandum of Law,

incorporated by reference herein as though set forth in full, Plaintiff's allegations for equal protection/race discrimination fail to state a claim for which relief may be granted. 5. In order to bring a claim for purported civil rights violations, a prisoner must

first exhaust all administrative remedies, including appeals thereof, before bringing a claim. 6. Plaintiff failed to exhaust his administrative remedies, and therefore, his

claims must be dismissed, as a matter of law. 7. Plaintiff has failed to set forth a meritorious claim for a purported violation

of the Equal Protection clause. WHEREFORE, Defendants Dough Petiford, Kathy Doatelli and Jay Sylvester requests that Plaintiff's Complaint be dismissed, as a matter of law.
