JUDICIAL CIRCUIT COMPLAINT Wage Withholding (Contempt of Court by Payor)
Plaintiff COMPLAINING OF THE DEFENDANT ABOVE NAMED, respectfully alleges and shows unto this Court: 1. That Plaintiff is the obligee of child support rights pursuant to the order of this court and that Defendant is the employer of
the obligor of said child support and this Court has jurisdiction of the parties and the subject matter; 2. That Defendant was ordered by this Court on ,2 to comply with the following requirements,
pursuant to Section 20-7-1315 of the 1976 South Carolina Code of Laws as amended : a. to withhold the sum of $ per from the wages of the obligor; and
b. to notify the clerk's office if health insurance is available to the obligor for the benefit of the child(ren) for whom child support is being withheld. 3. That Defendant has failed and refused to comply with one or both of the following requirements as ordered by this Court,
pursuant to Section 20-7-1315 of the 1976 South Carolina Code of Laws as amended : a. to withhold said sum as ordered by this Court; and/or
b. to notify the clerk's office if health insurance is available to the obligor for the benefit of the child(ren) for whom child support is being withheld. 4. That the Plaintiff asks this Court to issue its order and Rule to Show Cause directed to Defendant requiring it to appear and
show cause why it should not be held in contempt of Court for failure to abide by said Court order; WHEREFORE, Plaintiff prays that this Court inquire into the matters alleged herein and issue its order: (a) Directing Defendant to appear before this Court and show cause why it should not be held in contempt of Court for failure to comply with the order of this Court; (b) Declaring Defendant to be in contempt of Court and imposing such penalties upon Defendant as may be authorized by law; (c) For such other and further relief as may be reasonable, just and proper.
