INSTRUCTIONS FOR MOTION FOR MODIFICATION OF PARENTAL RESPONSIBILITY (CUSTODIAL ARRANGEMENTS) OR ALLOCATION OF DECISION-MAKING RESPONSIBILITY

This Motion is used when you want to change the existing Court order (that was entered in a divorce case or in a custody case) concerning parental responsibility (custodial arrangements) or allocation of decision-making responsibility. If circumstances have changed since the Court entered its order concerning parental responsibility (custodial arrangements) or allocation of decision-making responsibility, you may file a motion for modification of the existing order.

Fill in the full names and ages of all of your children who are subject to the order.

In paragraph 5, describe precisely the change you are requesting.

The party who is seeking a modification of the order must file an affidavit with the motion, which explains the reasons why the party believes the requested change is in the best interests of the child(ren). The affidavit must be signed and notarized. The statements in the affidavit are made under oath, subject to the penalty of perjury, just as if they had been made in Court. If an affidavit is not filed, the motion will be automatically denied.

At the final hearing, you will need to give the Court a copy of a Parenting Plan, setting forth how you would like the Court to modify parental responsibilities (custodial arrangements) or allocation of decision-making responsibility. A Parenting Plan form is available at the courthouse.
