RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT AND FOR CAUSE AS IFOLLOWS:

To modify the defendant’s conditions of supervised release to include mental health counseling. On Nove ber 17, 2006, the
defendant tested positive for marijuana. The defendant reported that he is struggling with the death of Iis mother which
occurred the day before Thanksgiving 2005. Upon completion of the defendant's relapse prevention group hIe can matriculate _
into mental health treatment.

On December 5, 2006, the defendants attorney, Assistant Federal Defender Gary Weinberger was notified cIf this request and
he had no objections to the modification. l
