Re: Cephalon, Inc., et al. v. Barr Laboratories, Inc. (C.A. No. 05—29—JJF)
Dear Judge Farnan:
At the end of our Markmcuz hearing on September l4th, Your Honor proposed
three possible trial dates: February 6, April 3 or April l0, 2006. I am writing to inform Your
Honor that Barr would prefer the earliest available date. However, a scheduling conflict
presently exists The week of February 6m. Thus, Barr is amenable to proceeding with trial the

week of April 3f og April 10 . Barr would also be agreeable to an earlier date other than the
week of February 6t , should the Court’s schedule so permit.
As we indicated at the Markmazz hearing, we believe this would be a short trial of
about three or four days duration.
