On April 6, 2007, the Court received the second Supplemental Brief of Amicus Curiae Rails-to-Trails Conservancy (the Conservancy) in support of Defendant's Motion for Summary Judgment. This brief is being returned to the Conservancy in accordance with this Court's Order of October 23, 2006, which requested that "If the Rails-to-Trails Conservancy wishes to participate in any manner extending beyond the filing of the proffered brief, it must file a motion explaining the specific benefits to the Court of its proposed additional contribution to the proceedings in this case." Notwithstanding the October 23 Order, a supplemental brief of amicus curiae Rails-to-Trials Conservancy in support of Defendant's Motion for Summary Judgment was inadvertently filed by the Clerk's office on February 12, 2007. As this case was designated as an electronic case in the Court's case management/electronic case filing (CM/ECF) system on March 29, 2007, the Conservancy must electronically file a motion for leave to file the second Supplemental Brief, with the proposed brief attached to the motion. Pursuant to General Order 42, the attorneys of record must have a CM/ECF account. The Court issues an account login and password only to members of the Court's bar who have passed a certification test.

Records before the Court indicate that the Rails-to-Trails Conservancy's Counsel has not complied with this requirement. If Counsel has questions on what is required, please contact the CM/ECF User Assistance line at (866) 7846273 (toll free) or (202) 357-6402, Monday to Friday, 9 a.m. to 5 p.m. The Court's website also addresses this issue. The Clerk's Office is directed to send to the Rails-to-Trails Conservancy a hard copy via U.S. mail of this electronic Order. IT IS SO ORDERED.
