As a result of a filing error, the motion filed yesterday (Dkt No. 511) was not in all respects the same as what intervenors' counsel had previously presented to Defendant's counsel as what intervenors intended to file; however, during a telephone conversation July 20, 2007, Defendant's counsel authorized movants' counsel to state that Defendant consents to entry of the proposed Order (Dkt No. 511-2) attached to the motion. Defendant's counsel and undersigned counsel note that the agreed-upon form of proposed Order addresses disclosure to counsel of record only and not Ms. Felix.
