JOINT STATUS REPORT Pursuant to this Court's Order of December 3, 2007, the Plaintiff, L. Tim Wagner, Liquidator of Amwest Surety Insurance Company in Liquidation ("Liquidator") and the Defendant, the United States of America ("Government"), hereby submit the following status report. Since their meeting in Washington on October 10, 2007, representatives of the U.S. Government and the Amwest Liquidator have continued their discussions regarding open items. Representatives of the Amwest Liquidator and the U.S. Small Business Administration had a conference telephone call on January 16, 2008 to discuss open items, which was followed by discussions between the Amwest Liquidator's attorney and the United States Department of Justice Attorney. The SBA and the Amwest Liquidator know each other's

positions on the items in dispute and are working to reach satisfactory resolutions on these items. Substantial progress has been made on these items. The Department of Justice Attorney and the Liquidator's legal counsel have also begun to address all other open matters and expect to make significant progress prior to the next report date.
