DANIEL THIS MATTER is before the Court on a review of the Phase III motions to be heard at the hearing set to commence Monday, May 15, 2006. As addressed at the status conference on April 11, 2006 and in the parties' status report sent via email on that date, certain motions filed by Defendants involve both legal issues and evidentiary issues for which I have ordered the Government to submit a written proffer. I stated that I would advise whether any of the legal issues raised in those motions would be addressed at this hearing. I have determined that I will hear argument on the legal issues raised in the motion. Thus, the parties should be prepared to address those issues, including the legal relevance of certain categories of the offenses and/or incidents that the Government seeks to admit (i.e, whether they are per se inadmissible) and the burden of proof for admission of such incidents. I defer to the August hearing, however, any issues about whether the particular incidents are relevant under the circumstances of this case, the reliability of those particular incidents, and whether the incidents are admissible under 18 U.S.C. § 3593(c).
