Although appointed counsel did not represent Mr. Jones in the underlying

prosecution, he has obtained and reviewed copies of the pre-sentence report and the relevant judgment, consulted with Mr. Jones by telephone, and studied the applicable Manual for the 2000 United States Sentencing Guidelines. Mr. Jones was charged and convicted with aiding and abetting an offense

involving seven grams of crack. The date of the offense was May 22, 2001. No firearms or other controlled substances were implicated in computing the applicable offense level. At a sentencing hearing on December 3, 2003, the Court determined that a total ofn el e o 2 a pe . . o e 'r n l ioy ae oys e e V.T e f s e l f 8 p ld MrJ n sci a h tr c tg r iL v l I h e v i mi s Court determined that the applicable sentencing range was 140 to 175 months, and sentenced the defendant to 140 months, i.e. to the bottom of the range. 3. Under the amendment to the applicable guideline, 2D1.1, as implemented

by guideline 1B1.10(a), MrJ n s a v o total offense level is 26. Using the 2000 . o e ' d i ry s Guidelines sentencing table, Mr. J n sn ws ne c grn ei1 0 o e ' e e tn i a g s 2 -150 months. To n benefit from and conform with the retroactive application of the guideline amendment, Mr. Jones should be resentenced to 120 months, or the bottom of the lower guideline range. Although Mr. Jones was sentenced before Booker v. United States was decided, he is willing to waive a further hearing to consider 18 U.S.C. § 3553(a) factors if the Court is disposed to impose the 120 month sentence which we believe is indicated. 4. substitute CJA counsel, the undersigned has contacted assistant U.S. attorney Guy Till, who advises that the Justice Department will not be taking a position on this matter before March 15, 2008, in deference to the Congressional debate about whether to pass new sentencing legislation in response to the pertinent guideline amendment. If the government does not stipulate to the relief sought when it does respond, Mr. Jones respectfully requests the opportunity for reply.
