submits this Motion for Leave to Appear by Telephone at the Status Conference scheduled for
December 21,2007 at 1:30 p.m. As grounds therefore, the County states the following:
1. This case has been inactive since the County filed its Reply on Motion Requesting

Evidentiary Hearing on May 15,2007.
2. Counsel for the County was contacted regarding the scheduling of

the status

conference at time when both attorneys were out of the office.

3. Counsel for the County did not anticipate availability on the dates proffered by
the Cour due to previous time commitments, including a two-day trial commencing on

December 20 in the Pitkin County District Cour.
4. Counsel shall make itself available to the Cour on the scheduled date and time;

however, due to counsels' previous commitments and the pervasive diffculty of

travel from

Aspen to Denver in the winter, the County respectively requests that it shall be allowed to
paricipate by telephone.

5. Counsel for the County attempted to contact the other paries to this action to

insure they have no objection to the County's appearance by telephone, but were unable to do by
the time of this filing.

WHEREFORE, the County moves the Cour for leave to appear by telephone at the status
conference on December 21, 2007 at 1 :30 p.m.
