concerning the Court's Preliminary Jury Instructions in Civil Cases: Instruction No. 1: Instruction No. 2: Instruction No. 3: Instruction No. 4: Instruction No. 5: Instruction No. 6: No objection. No objection. No objection. No objection. No objection. Erchonia does not object to this instruction on the burden of proof in
civil cases per se, but objects to it only because it does not address the clear and convincing burden of proof, which is applicable in this case both to Plaintiff's claims of patent invalidity and to Erchonia's claims of willful patent infringement. Erchonia has prepared and submitted an alternative instruction based on MODERN FEDERAL JURY INSTRUCTIONS 86-6 that addresses both the preponderance of the evidence standard and the clear and convincing standard. Instruction No. 7: No objection.
