VGIEREAS, under the Court’s Scheduling Order dated November 6, 2006
(D.I. 83) bifurcating the contract and patent infringement issues, discovery on the
contract issues has been completed and the time for tiling case dispositive motions on the
contract issues has not been reached;
WHEREAS, the parties believe it would be beneficial to Court and the
parties to set a definitive filing date for case dispositive motions on the contract issues;
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by
and between the parties, subject to the approval of the Court, that all case dispositive
motions for the contract phase are due gg; May 4, 2007. The remainder of the Scheduling
Order remains unchanged.
