GOVERNMENT'S STATUS REPORT ON ISSUE OF COMPETENCY

Comes now the United States of America and respectfully files this Status Report with regard to the government's position as to defendant's competence and Competency Hearing presently set for February 22, 2007. The government avers as follows: 1. The government is presently in possession of two forensic reports from

psychological and psychiatric experts opining that the defendant, Gwen Bergman, is incompetent to proceed at this time. As a result, the government believes that a competency hearing should be held in this matter by the Court; further, the government has no objection to proceeding with the Competency Hearing on February 22, 2007 at 9:00 a.m. The government anticipates calling both Dr. Fukutaki and Dr. Bograd at that time.
