The Court, upon reviewing the Stipulated Motion to Amend Order Dismissing Procedural Due Process Claim 3(B), and being fully advised, ORDERS: That the motion is GRANTED. The February 23, 2007 order dismissing without prejudice Claim 3(B) for injunctive relief for denial of procedural due process with regard to ADX step-downs is amended. Claim 3(B) for injunctive relief for denial of procedural due process with regard to ADX step-downs is dismissed with prejudice with each party to bear their own fees and costs.
