Leone, Acting United States Attorney, and Elizabeth A. Weishaupl, Assistant United States Attorney, hereby file the following Status Report to the Court. 1. The parties have reached amicable settlement of this matter.

A Settlement Agreement resolving all issues in this matter is in the process of being drafted and reviewed by the parties.

A Motion to Dismiss this matter with prejudice can be filed upon execution of the settlement agreement.

4.

It is anticipated that this Motion can be filed no later than July 18, 2005.

Wherefore, the parties file the following Status Report to the court.
