Dear Judge Farnan:
We are counsel to Paul, Hastings, Janofsky & Walker LLP (“Paul
Hastings"). We write in response to tt e letter dated September E6, 2005
submitted to the Court by counsel for Magten Asset Management Corporation
("Magten"), requesting a scheduling conference to address matters currently
pending before the Court.
We respectfully suggst that a scheduling conference in this case is
premature at this time. Paul Hastings itselieves that the issues raised by Case No.
04-1389, in which NorthWestem has moved to dismiss Magteifs pending appeal
of the confirmation order on mootness grounds, would resolve most if not all of
the matters currently before this Court. Until such time as the Court decides
NorthWestem’s motion to dismiss Magterfs appeal, therefore, Paul Hastings does
not believe that a scheduling cont`eren=1:e is necessary.
