Defendant, ROSESTAR SOUTHWEST, LLC d/b/a HYATT REGENCY BEAVER CREEK, through its attorneys, Warnquist and Associates, submits the following Motion to Reschedule the Scheduling/Planning Conference currently set for December 5, 2002 at 10:00 a.m. As grounds for this Motion, Defendant states as follows: 1. Undersigned counsel has conferred with Plaintiff's counsel, who has stated that

there is no objection to the request to reset the currently scheduled conference. 2. Undersigned counsel is scheduled for surgery on December 4, 2002 and has been

informed by his medical provider that he should not participate in any type of work activities the day after surgery. WHEREFORE, Defendant requests that the Court vacate the scheduling/planning conference currently set for December 5, 2002 and provide the parties with a new date.
